The U.S. Department of Commerce recently adjusted the countervailing duties imposed on Moroccan phosphate fertilizer exports to the United States, lowering the rate from 16.81% to 16.60%.
This adjustment followed an appeal by the OCP Group against the U.S. decision to raise the tariffs to 16.81%, arguing that ministerial errors were made in calculating the rates, including the omission of significant data such as the Moroccan company’s debts.
Under U.S. regulations, a “ministerial error” refers to any unintentional error in calculations or writing that affects the final results. In response to these claims, the U.S. Department of Commerce revised the tariffs accordingly.
